Terms and Conditions
Last updated: 13 October 2026
These Terms and Conditions (“Terms”) govern your access to and use of Picmato (the “Service”) operated by Picmato (“we”, “us”, “our”). By creating an account, purchasing credits, or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. Acceptance of Terms
By signing up for, accessing, or using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not access or use the Service.
2. Account & Eligibility
You must be at least eighteen years old and capable of forming a legally binding contract to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate and complete registration information.
3. The Service
Picmato provides an AI creative engine that converts your uploaded product photographs or marketplace listing URLs (such as Amazon, Walmart, Flipkart, or Meesho) into listing-ready sets, infographics, lifestyle visuals, and multi-format ad assets. Outputs are generated automatically using machine learning models and may vary in artistic style. We may add, modify, or discontinue features at any time.
4. Credits, Pricing & Payments
- Credit consumption: One credit corresponds to one generated or enhanced image asset. Credits are non-transferable.
- Credit validity: Purchased top-up credits remain valid as long as your account is active. Monthly plan credit allowances renew on your account billing cycle.
- Transparent pricing: All prices are displayed at checkout and are inclusive of applicable taxes unless stated otherwise.
- Payment processing: Payments are processed securely by third-party payment gateways. Picmato does not store sensitive card or banking credentials.
- Automatic technical restoration: If an image generation fails to deliver an asset due to a server error or timeout, the consumed credit is automatically restored to your credit vault immediately.
5. Your Content & Ownership
Your Inputs: You retain complete ownership of all product photographs, URLs, logos, and materials you upload. You grant Picmato a limited license to store, analyze, and process this content solely for the purpose of generating images and creatives for your account.
Your Outputs: You own the finished listing images, infographics, and marketing assets generated for your account. You may use them for any commercial purpose, including marketplace listings (Amazon, Walmart, Flipkart, Meesho, eBay, Shopify), ad campaigns, and social media.
You warrant that you hold all necessary rights, licenses, and permissions to upload the source photographs and that they do not infringe any third-party intellectual property or privacy rights.
6. Acceptable Use
You agree not to use the Service to:
- Upload photographs or content that you do not have legal authorization to use.
- Generate deceptive, counterfeit, unlawful, defamatory, or harmful imagery.
- Reverse engineer, decompile, scrape, or extract underlying models and prompt weights.
- Interfere with, overload, or compromise system performance and security.
- Resell access or build a competing commercial platform on top of Picmato without written consent.
7. Intellectual Property
The Service, including software, design systems, algorithms, documentation, trademarks, and branding created by Picmato, is the exclusive property of Picmato and protected by applicable copyright, trademark, and intellectual property laws. Nothing in these Terms grants you ownership of the platform itself.
8. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. While Picmato optimizes templates for major marketplace guidelines (such as Amazon main image white background standards), marketplace policies evolve continuously. You remain responsible for reviewing and confirming that exported assets comply with the guidelines of the specific channels where you publish.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Picmato's total aggregate liability for any claims arising out of or related to the Service is limited to the amount you paid to Picmato in the three (3) months preceding the event giving rise to the claim. In no event shall Picmato be liable for any indirect, incidental, consequential, special, or punitive damages.
10. Termination
You may close your account at any time through account settings or by contacting support. We reserve the right to suspend or terminate accounts that breach these Terms or our Acceptable Use policy, with or without prior notice. Provisions that by their nature should survive termination will continue in effect.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
